Competences
The scope of competences is defined under Article 187 of the PPL, which sets forth that the Republic Commission:
- decides on request for protection of rights;
- decides on appeal challenging decision of contracting authority;
- decides on contracting authority’s proposal that the filed request for protection of rights does not suspend further actions in the PP procedure at issue;
- decides on proposal of complainant filing request for protection of rights, to proscribe the resumption of PP procedure, and/or concluding or implementing PP contract;
- decides on the costs of the protection procedure, and the costs of bid preparation;
- monitors and oversees the execution of its decisions;
- impose fines in accordance with the PPL;
- annuls contract in accordance with the PPL;
- files request to initiate misdemeanor proceedings where, acting within its competences, finds that a committed violation of this Law may be the subject of misdemeanor liability;
- cooperates with national and foreign institutions and experts in the domain of public procurement, to improve the public procurement system, and especially the protection of rights and other procedures within the competences of the Republic Commission;
- performs other tasks in accordance with the law.
