The Republic Commission for the Protection of Rights in Public Procurement Procedures (hereinafter: the Republic Commission) continued its successful cooperation with the SIGMA/OECD initiative by holding a workshop at its headquarters on June 15, 2023, which, in addition to members of the Republic Commission, was attended by employees of the Service of the Republic Commission and representatives of the Office for Public Procurement.
The lecturers at the workshop were Mrs. Aleksandra Melesko, Senior advisor for public procurement at SIGMA/OECD and Mr. Sašo Matas, Director general in the Public Procurement Directorate of the Ministry of Public Administration of the Republic of Slovenia.
The workshop was devoted to the following topics: the application of the European Single Procurement Document (ESPD) and the relationship with the normative framework and practice in the Republic of Serbia, “reliance on the capacities of third parties”, as well as the presentation of the analysis of the effects of the implementation of “green procurement” in the Republic of Slovenia.
Also within the framework of the workshop, regular monitoring of the practice of the European Court of Justice in the field of public procurement continued.
Mr. Matas, an eminent expert in public procurement within the workshop, spoke in detail about the purpose, advantages and structure of the European Single Procurement Document (ESPD) according to the Commission implementing regulation (EU) 2016/7, conditions, admissibility and evidence in the context of “reliance ” of bidders on the capacities of third parties in public procurement procedures and the compliance of practice in the Republic of Serbia with the same. He put special emphasis on the positive effects of environmental protection, competition and financial effects, in connection with the introduction of ecological criteria in public procurement in the Republic of Serbia, with points of view of the results of the analysis of the impact of ecological criteria on practice in the Republic of Slovenia in the period from the beginning of the implementation of Directive 2014/23/EU of the European Parliament and of the Council; Directive 2014/24/EU of the European Parliament and of the Council.
Ms. Melesko, as an expert with many years of work experience at the European Court of Justice, dedicated her presentation to the judicial practice of the European Court of Justice, with a focus on relevant judgments in the field related to the topics of the workshop.
Considering the interesting topics and the exceptionality of the presenters, the workshop was highly interactive and based on examples from the experience of the lecturers and the practice of the Republic Commission and the Office for Public Procurement.
