For public procurement procedures initiated in accordance with Public Procurement Law (“Official Gazette of Republic of Serbia” no. 116/08), protection of rights proceedings are conducted in accordance with the Public Procurement Law (“Official Gazette of Republic of Serbia” no. 116/08).

Explanation:

Bearing in mind that Article 172 Paragraph 1 Public Procurement Law (“Official Gazette of Republic of Serbia” no. 124/12; hereinafter: PPL), prescribes that public procurement procedures initiated before this Law enters into force are regulated by legislation in force at the time they were initiated, and as protection of rights proceedings cannot be separated from public procurement procedure, meaning that public procurement procedure is not completed unless initiated protection of rights proceedings are not completed, therefore in these cases Public Procurement Law (“Official Gazette of Republic of Serbia” no. 116/08) will be applied to the protection of rights proceedings accordingly.
