For second phase of restricted procedure initiated after April 1st 2013 provisions of the Public Procurement Law (“Official Gazette of Republic of Serbia” no. 116/08) are applied, if restricted procedure was initiated in accordance with the provisions of the same law.

Explanation:

The day Public Procurement Law (“Official Gazette of Republic of Serbia” no. 124/12; hereinafter: PPL/2012) became effective the Public Procurement Law (“Official Gazette of Republic of Serbia” no. 116/08; hereinafter: PPL/2008) and bylaws made base on PPL/2008 ceased to be in force. PPL/2012 came into effect on January 6th, 2013 and is being applied as of April 1st, 2013, except for the provisions of Article 78 that are to be applied as of September 1st, 2013.

Article 172 Paragraph 1 of PPL/2012 prescribes that public procurement procedures initiated before this Law enters into force shall be regulated by legislation in force at the time they were initiated.

If restricted procedure was initiated in accordance with the PPL/2008, this means that in accordance with Article 2 Paragraph 1 Point 7 of PPL/2008, establishing that restricted procedure is conducted in two phases and that only candidates can submit the bid in the second phase, second phase of restricted procedure initiated after April 1st 2013 is regulated by PPL/2008.
